TRAKNOCK

Terms of Use

Version 2 — Last updated: 18 September 2026 · Previous version: 7 September 2026

This document is the whole of the contract between the person using the Traknock mobile application and the service provider. It is long for a reason: it sets out how the application actually works, and the legal basis of each provision, without concealment.

Status and identity details — read this first

As at today's date the service provider is a natural person. Incorporation of the company behind Traknock has not yet been completed. The trade name, the postal address for service, the telephone number and the Turkish central registry (MERSİS) and tax details will be entered into this text once incorporation is complete; until that date those fields are answered by the natural person service provider trading under the name Traknock. This does not remove the service provider's responsibility under data protection, content or consumer law; it attaches that responsibility to a natural person rather than to a legal entity.

In this version the following provisions have not yet entered into force, and their entry into force will be announced separately on this page:

Those two sentences are an undertaking. If the app were published in a store before the identity details were completed, this text would itself be evidence of the breach; that consequence has been accepted deliberately.

Provisions we draw to your attention in particular

This contract consists of standard terms: it is not negotiated individually but drawn up in advance and presented to every user in the same form. Under Article 21/2 of the Turkish Code of Obligations No. 6098 ("TBK"), surprising clauses — clauses alien to the nature of the contract and to the character of the business — are deemed not written. Rather than bury the clauses that may be surprising or fall outside your expectations, we collect them here:

ARTICLE 1 — Parties, identity of the service provider and service of notices

1.1. The parties to this contract are the service provider that operates the Traknock mobile application and the pages under the traknock.com domain, and the natural person who uses the application. In this text "we" and "Traknock" mean the service provider and "you" means the user.

Service provider (natural person): Fahri Selçuk
Trading name: Traknock
Country of establishment: Türkiye
Telephone: +90 533 598 34 09
The postal address for service will be entered in this field; the app will not be published in any app store before that information has been published. The trade name and the MERSİS and tax identification details will be added once incorporation of the company is complete.
Email: info@traknock.com
Data protection requests: privacy@traknock.com

1.2. The service provider is also, for the purposes of data protection legislation, the data controller, and for the purposes of Turkish Law No. 5651 it holds the capacities of content provider, hosting provider and social network provider. Under European Union law, where the service is offered in the Union, it is a provider of hosting services within the meaning of Regulation (EU) 2022/2065 (the "Digital Services Act"). The consequences of these capacities are explained in Articles 23 and 24.

ARTICLE 2 — Definitions

In this contract the following terms have the meanings set out below:

ARTICLE 3 — Subject matter of the contract and its annexes

3.1. Traknock is a mobile application that enables drivers to help one another in traffic, to share road conditions and to communicate. The subject matter of this contract is the terms on which that service is supplied and used.

3.2. The following documents form an integral part of this contract and are to be read together with it:

3.3. In the event of a conflict between those documents, the Distance Sales Agreement prevails on matters concerning in-app purchases, the Privacy Policy prevails on matters concerning personal data, and this text prevails on all other matters. In every case the provision more favourable to the consumer applies.

ARTICLE 4 — Formation of the contract, the moment of acceptance, and its status as standard terms

4.1. Formation and moment of acceptance. The contract is formed at the moment you install the app on your device and begin to use it. If you do not accept these terms, do not use the app, and uninstall it if it is installed.

4.2. The separate confirmation step. At sign-up, a screen shows these terms and the Privacy Policy separately and obtains acceptance separately (added on 21 September 2026). The Privacy Policy is a privacy notice, and under the decision of principle of the Turkish Personal Data Protection Board (No. 2026/347) it is not tied to a consent mechanism; at sign-up it is only summarised, with a link to the full text, and no acceptance is requested for it. The only step that requires acceptance is agreeing to these Terms of Use, which are a contract — the two are not combined into a single checkbox, and supply of the service is not made conditional on consent to processing for marketing purposes. The same separation is required for users in the European Union by Article 7(2) and (4) of the General Data Protection Regulation ("GDPR").

4.3. Status as standard terms. This text constitutes standard terms within the meaning of Article 20 TBK: it has been drawn up in advance and unilaterally by us, for use in a large number of similar contracts. We accept the legal consequences of that here:

4.4. Prohibition of unfair terms. If you are using the app as a consumer, then under Article 5 of Turkish Law No. 6502 on the Protection of Consumers, terms included in the contract without being negotiated with you which, contrary to the requirement of good faith, cause a significant imbalance in the parties' rights and obligations to your detriment are unfair terms and do not bind you. If such a term is found in this text, that term is null and void; the remaining provisions of the contract remain valid. For consumers in the European Union the same result follows from Council Directive 93/13/EEC as transposed into the law of your Member State.

4.5. The acknowledgements in this Article have been written deliberately and expressly, to be construed against us in future. The purpose is to prevent this contract from becoming the document of the stronger party alone.

ARTICLE 5 — Minimum age and capacity

5.1. Türkiye. To use the app from Türkiye you must be at least 15 years old. That limit follows from Additional Article 4/7 of Turkish Law No. 5651, which prohibits social network providers from supplying services to children who have not completed the age of fifteen and requires the necessary measures, including age verification, to be taken. That provision enters into force on 1 November 2026; we have made that age limit a term of this contract already, without waiting for that date. Unlike some other paragraphs of Additional Article 4, that obligation is not conditional on any daily-access threshold; it arises for every provider that qualifies as a social network provider. Whether the limit is technically verified today is stated plainly in Article 5.5.

5.2. European Union. Article 8 of the GDPR sets at 16 the age at which a child's consent can by itself be valid for information society services offered directly to a child, and allows Member States to lower that age to no less than 13. The limit in force in the country where you are applies. That provision bears only on processing founded on consent; the core processing of location data rests on performance of the contract, as stated in Article 7.5.

5.2/a. Other countries, including the United States. Elsewhere you must be at least the age required by the law applicable to you and, in any event, at least 13. The app is not directed to children under the age of 13 and we do not knowingly collect personal information from them within the meaning of the Children's Online Privacy Protection Act (15 U.S.C. §§ 6501–6506) and the Children's Online Privacy Protection Rule (16 C.F.R. Part 312). Consistently with this, when the app is submitted to an app store its target audience will be declared as older users, not children. If we learn that an account belongs to a child under 13 we close the account and delete the associated data; a parent or guardian may request the same at privacy@traknock.com.

5.3. Capacity. Under Article 16 of the Turkish Civil Code No. 4721, minors and persons under limited guardianship who have the capacity to discern may not place themselves under an obligation by their own transactions without the consent of their legal representative. If you are under 18 you may enter into this contract only with the permission of a parent or guardian. A contract treated as formed without that permission is in abeyance until the legal representative approves it.

5.4. We do not treat a parent or guardian as a party to, or as responsible under, this contract without their knowledge and their will; such a clause would not be legally effective. Instead: if we establish that the age requirement is not met, we close the account and delete the associated data.

5.5. Age verification and parental controls. At sign-up you are asked to declare your date of birth, and a declaration showing an age under 15 blocks account creation. This is a self-declaration check, not an official identity-based verification; Law No. 5651 envisions an age-verification method that runs through e-Devlet (the Turkish e-Government gateway), whose exact mechanics are left to a BTK regulation that has not yet been published — once it is, we will adapt this flow to it. A minimum step has been taken on the parental control required by Additional Article 4/20 (21 September 2026): a user who declares being between 15 and 17 is asked for a separate declaration that they are using the app with the knowledge and permission of a parent or guardian; sign-up is not completed without it. This is a declaration step that makes visible the permission already required by Article 16 of the Turkish Civil Code — it is not a technical control tool that verifies a parent's identity or restricts use. The actual tool envisioned by the BTK regulation will be added, once that regulation is published, before publication in any store. We write this here rather than conceal it.

ARTICLE 6 — Account, username and device limit

6.1. We do not ask for an email address, a telephone number or a password in order to open an account; the session is opened anonymously. The username, display name, profile photograph and vehicle details you attach to your account are your own declaration.

6.2. Your obligations:

6.3. Limit on accounts per device. To make abuse harder, at most 3 accounts may be opened on one device. The limit is enforced through an irreversible digest of the device identifier; the raw device identifier is not sent to the server and is not stored. Attempting to exceed the limit by technical means is a breach of contract.

6.4. When you delete your account, your place in the device limit is released. Which records are deleted after deletion and which remain is set out in detail in the Privacy Policy and on the Account and Data Deletion page.

ARTICLE 7 — Location sharing and visibility

7.1. Your location is written to the server only while Driver Mode is on. When you switch Driver Mode off you drop off the map immediately.

7.2. While Driver Mode is on, your location is visible to every user registered with the app — not only to people you know or to those near you. The same applies to your display name, your profile photograph, your vehicle details and your number plate. This is the natural consequence of how the product works: for someone stranded on the road to see the drivers near them, drivers have to be visible. Decide in the knowledge of that.

7.3. The app does not collect location in the background. No background location permission is requested and no location is written while the app is closed.

7.4. Your live location is not accumulated as a separate history record; each value overwrites the last. The road reports and street chat messages you send do, however, carry the location information as at the moment they were sent. The detail is in the Privacy Policy.

7.5. The legal basis for this core processing of your location data is that it is necessary for performance of the contract, under Article 5/2(c) of Turkish Law No. 6698 on the Protection of Personal Data ("KVKK") and Article 6(1)(b) GDPR; without location the service does not work. Processing for advertising and analytics purposes is subject to separate, withdrawable consent.

ARTICLE 8 — Driving safety and the interaction lock

8.1. Traknock is not designed to be used at the wheel. Article 73(c) of Turkish Highway Traffic Law No. 2918 prohibits drivers from holding and using mobile telephones and similar communication devices while the vehicle is in motion. Compliance with that prohibition is exclusively the driver's responsibility and no feature of the app removes that responsibility. Equivalent rules apply in the European Union and in the United States under national, state and local traffic law.

8.2. How the lock actually works. The app locks the messaging, window knock and purchase screens when the speed of the vehicle exceeds 15 km/h, and the lock is released when the speed falls below 10 km/h. That threshold does not come from a legal requirement but from a deliberate product choice: no traffic legislation defines a numerical km/h threshold. The consequence, which we do not hide, is this — at speeds below 15 km/h the lock does not engage.

8.3. Passenger declaration. The lock can be released by the declaration "I am a passenger" given when Driver Mode is switched on, or by the single-tap "I am a passenger" confirmation on the lock screen. The instant confirmation is required again at the start of each new movement; the declaration given at the start of a session is reset when Driver Mode is switched off.

8.4. Declaring "I am a passenger" while you are in fact driving is a breach of the rules and is subject to the sanctions in Article 22. Attempting to disable the lock itself by technical means is likewise a breach. Using the passenger declaration that the app itself offers is not a breach.

8.5. The lock is a safety aid, not a safety guarantee. Complying with traffic rules, keeping your attention on the road and all legal responsibility arising from the operation of the vehicle are yours.

ARTICLE 9 — Road reports and community verification

9.1. Road reports are created by users and verified by users. Traknock does not guarantee that those reports are accurate, current or complete. You are responsible for the consequences of the driving decisions you take on the basis of them.

9.2. Lifetimes of reports. Road reports are deleted automatically after the periods set out below, according to their category. The deletion job runs every 30 minutes; actual deletion therefore takes place at the first run after the period has expired.

Category of reportLifetime
Traffic30 minutes
Help call1 hour
Road cleared1 hour
Accident2 hours
Ice6 hours
Warning12 hours
Information24 hours

9.3. Community voting. Reports may be voted "correct" or "incorrect" by other users. Where a report receives four "incorrect" votes, the report is removed and the free report entitlement of the user who posted it is cancelled for the following day. This is not a monetary penalty; purchased tokens are not touched, and any token spent on that particular report is not refunded. You cannot vote on your own report.

9.4. Knowingly posting a false report is in addition a prohibited act under Article 19.

ARTICLE 10 — Help calls

10.1. Traknock is not an emergency service. The help call feature consists of nothing more than sending a notification to nearby users. There is no undertaking that anyone will see it, read it or come to help. In a real emergency call your local emergency number — 112 in Türkiye and across the European Union, 911 in the United States — and the relevant roadside assistance service.

10.2. Sending a help call is free of charge. A waiting period of 2 hours from the previous call applies before a new help call may be sent from the same account; the purpose is to prevent abuse of the system.

10.3. A chat opened through a help call is free: the person who says "I am on my way" and the person who made the call pay no tokens while they exchange messages. That exemption continues after the help has ended.

10.4. Going to help is voluntary. The service provider is not a party to the assistance relationship that arises between users; liability arising from that relationship is subject to Article 28.

ARTICLE 11 — Window knocks

11.1. A window knock is a notification in the nature of a greeting, sent to a driver you see on the map. It costs 10 tokens; 2 window knocks per day are free.

11.2. A window knock is valid inside the app for 15 minutes; if it is not answered within that period it counts as unanswered.

11.3. Persistent, harassing or surveillance-driven use of window knocks is prohibited under Article 19.

ARTICLE 12 — One-to-one messaging and the message fee

12.1. One-to-one messaging costs tokens:

The moment the other party writes, the counter resets and the fee for the next message starts again at 100 tokens.

12.2. This design is deliberate: persistence has to stop somewhere, otherwise a user with enough tokens could buy the ability to pester. The lock is a restriction for the person sending and a protection for the person receiving.

12.3. The fact that what you can do with the tokens you have bought is limited by the conduct of the other party is part of the main characteristics of the product you are buying, and it is for that reason stated expressly both here and in the Distance Sales Agreement.

12.4. Chats arising from a help call are free under Article 10.3.

12.5. Messages are not end-to-end encrypted. They are encrypted in transit and stored encrypted on the server; they are, however, scanned automatically on the server for content moderation purposes (see Article 22).

12.6. Tokens spent on a masked message. Where a message sent by spending tokens is masked by the automated moderation described in Article 22, the message counts as sent and the tokens spent are not refunded automatically as the system is built today. If you consider that result unfair in your case, you may request a refund through the route in Article 22.5; your rights under Turkish Law No. 6502 on Consumer Protection and the provisions of the Purchase Terms are reserved. The same provision appears in Article 11.7 of the Community Rules.

ARTICLE 13 — Street chat and general chat

13.1. The app has two room chats:

The messages in both rooms are open to every user registered with the app, and message length is limited to 300 characters.

13.2. Posting in either room requires a Prime subscription. Reading the rooms, seeing the messages and adding an emoji reaction to an existing message require no subscription and are free. If you have no subscription the message field is shown disabled. This is one of the provisions drawn to your attention at the start of this contract.

13.3. Every message you write in street chat records permanently, through the room identifier, which area of roughly 1 km you were in at that moment. There is no automatic deletion period for those messages. If you do not want your location to leave a permanent trace, do not write in street chat. General chat is not tied to location and does not have that consequence.

13.4. Messages written in the room chats are subject to the automated content moderation described in Article 22.

ARTICLE 14 — Vehicle details, number plate and photo verification

14.1. To appear on the map you are asked for the type, colour and number plate of your vehicle and for a photograph of it. Entering that information is the user's choice; once entered, it is open to every user registered with the app.

14.2. The actual scope of the verification. The vehicle photograph you upload is examined by an image labelling and text recognition library that runs on your device; the text in the photograph is read and compared with the number plate you entered. The reading is performed on the device and the plate that is read is not sent to the server. The photograph itself, however, is uploaded to the server — if it were not, nobody would be able to see the vehicle on the map.

14.3. This verification is not an identity verification. Failure to read the plate in the photograph at all is not a ground for rejection; only a clear conflict with the plate entered is rejected. No facial recognition is carried out and no facial template is extracted; the photographs are not processed as biometric data.

14.4. The check for inappropriate content applied to profile and chat photographs is likewise performed on the device and at the level of labels; there is no undertaking that it will filter out every item of inappropriate content. Cases that are not obvious are dealt with through user reports and moderation.

14.5. Entering a photograph or a number plate of a vehicle belonging to someone else as if it were your own is prohibited.

ARTICLE 15 — Tokens, free entitlements and rewarded advertising

15.1. A token is a virtual unit used to carry out certain actions inside the app. A token has no real-money equivalent; it cannot be converted into cash, transferred, moved to another account or inherited. A token is not a means of payment, electronic money or a crypto asset.

15.2. The actions for which tokens are spent, and the free entitlements:

ActionCostFree entitlement per day
Opening a chat (first message)100 tokens—
Second message before a reply50 tokens—
Third message before a replyLocked — cannot be released with money
Window knock10 tokens2
Road report5 tokens1
Help callFree1 call per 2 hours
Help chatFreeUnlimited

15.3. Rewarded advertising. You can earn tokens by watching rewarded advertisements: 5 tokens per view, up to a maximum of 6 views per hour. That ceiling exists for the sustainability of the token economy. Raising it operates at once because it is in your favour; lowering it is a material change to charging and may be made only by following the procedure in Article 26.3. This Article contains no clause giving us power to amend unilaterally to your detriment, and under Article 4.3 no such clause may be inserted.

15.4. When daily entitlements renew. On the server the counter for free daily entitlements resets at a fixed UTC+3 (Turkish time) change of day; Türkiye does not observe summer time, so that boundary is constant through the year. The counter shown in the app, however, currently follows your device's local time. Outside Türkiye those two measures may fall at different moments; where they do, the server counter governs. We write this here rather than conceal it, and bringing the two into line is on our list of work to be done.

15.5. We reserve the right to correct a balance where a technical error or abuse is established in the balance records. That power does not extend to tokens duly purchased and paid for; it is directed only at balances that have arisen erroneously or unlawfully.

ARTICLE 16 — Prime subscription

16.1. Prime is a subscription service supplied for a period, sold weekly or monthly and renewed automatically, and it has three tiers:

TierScope
Plus Browsing without appearing, seeing who viewed your profile, ad-free use, posting in general chat
Gold All Plus entitlements + 1 Boost per day + a frame coloured by tier (gold at Gold) on your card in the nearby drivers list
Platinum All Gold entitlements + 2 Boosts per day

16.2. Monthly plans additionally include a token bonus that varies by tier. Current prices and the current list of entitlements for each tier are shown on the purchase screen inside the app and in the Distance Sales Agreement; the list there is the binding one.

16.3. Token packages confer no Boost entitlement and no visual privilege. The only source of a daily Boost entitlement is a Prime subscription (Gold 1, Platinum 2). Whatever a token package may be called, it contains no permanent Boost entitlement, no frame and no other visual privilege.

16.4. Where the frame appears. The tier frame referred to in Article 16.1 appears at the edge of your card in the nearby drivers list inside the app. The gold ring that appears around a vehicle marker on the map is a different thing: that ring is tied to an active Boost window, not to a Prime tier, and it is not sold with a Prime subscription. We state the distinction expressly so that the two are not confused.

16.5. Automatic renewal and cancellation. Subscriptions renew automatically unless cancelled before the end of the period. Cancellation is carried out in the subscription management section of the app store through which the purchase was made. Deleting the app from your device does not cancel the subscription.

16.6. We accept that terminating a subscription may not be made subject to conditions more onerous than those for entering into it. Because the subscription is managed through the store, the cancellation flow is on the store's side; even so, if you meet difficulty in cancelling, write to info@traknock.com and we will pursue your request ourselves. For subscribers in the European Union the cancellation rights conferred by the national law transposing Directive 2011/83/EU, and for subscribers in the United States the rights conferred by the Restore Online Shoppers' Confidence Act (15 U.S.C. §§ 8401–8405) and by state automatic renewal laws, are reserved.

ARTICLE 17 — In-app purchases, right of withdrawal and lack of conformity

17.1. Token packages and Prime subscriptions are sold through the app store. Payments are processed by the store; Traknock does not see or store card details.

17.2. Right of withdrawal. Under point (ğ) of Article 15/1 of the Turkish Distance Contracts Regulation, there is no right of withdrawal in contracts relating to services performed instantaneously in an electronic environment and to intangible goods delivered instantaneously to the consumer. Our ability to rely on that exception depends on your confirmation, obtained at the time of purchase, that you request performance to begin immediately and that you will thereby lose the right of withdrawal. Where a purchase is made without such confirmation, your right of withdrawal is reserved. The confirmation step has been added to the purchase screen (21 September 2026). For consumers in the European Union the corresponding exception is point (m) of Article 16(1) of Directive 2011/83/EU, and it is subject to the same conditions of express prior consent and acknowledgement.

17.3. Lack of conformity. If the digital content you have purchased does not have the qualities stated in the contract, you may exercise the remedies of your choice under Article 11 of Law No. 6502 (rescission of the contract, reduction of the price, free repair, or replacement with a conforming item). Because a Prime subscription is a service supplied for a period, Article 15 of the same Law applies to a lack of conformity in that service. For consumers in the European Union the remedies in Articles 13 and 14 of Directive (EU) 2019/770 on contracts for the supply of digital content and digital services apply, as transposed into the law of your Member State.

17.4. The pre-contractual information, prices, refunds and complaints procedure relating to purchases are set out in the Pre-Contractual Information Form and Distance Sales Agreement. In the event of a conflict between this Article and that text, the Distance Sales Agreement applies, and in every case the provision more favourable to the consumer applies.

ARTICLE 18 — End of a token balance and of a subscription

18.1. If you delete your account of your own accord. Your unused token balance becomes unusable when the account is deleted. By contrast, your claim in respect of a purchased and unused subscription period is reserved: cancel your subscription before deleting your account, and if you deleted it without cancelling, write to us — we will assess your request and, where consumer legislation so requires, make a refund proportionate to the remaining period.

18.2. If your account is closed for a breach of the rules. Where an account is closed for breach of contract, the remaining token balance and the subscription entitlement come to an end. That outcome must be proportionate to the gravity of the breach; a minor first breach does not lead directly to permanent closure (see Article 22.4).

18.3. We are aware that the provisions of this Article may be regarded as unfair terms to the extent that they deprive a consumer of a price paid for something from which they have had no benefit at all (Article 5 of Law No. 6502; Council Directive 93/13/EEC). For that reason no absolute "no refund is made in any circumstances" clause has been inserted, and none will be.

18.4. You must cancel your subscription separately before deleting your account. That warning is also shown on the account deletion confirmation screen inside the app when you have an active Prime subscription (added on 21 September 2026).

ARTICLE 19 — Rules of conduct and prohibitions

19.1. The detailed rules are on the Community Rules page. The following conduct is a breach of contract and is subject to the sanctions in Article 22:

19.2. Prohibition on sharing another person's data. Sharing another person's number plate, face, vehicle photograph, name or location without their consent is prohibited. This is not merely a community rule but a legal prohibition: a number plate is personal data that makes a person identifiable through vehicle ownership.

19.3. Criminal liability. Some of the conduct above may at the same time constitute a criminal offence. We set this out by way of information, by reference to the Turkish Penal Code No. 5237 ("TCK"); equivalent offences exist in the law of the European Union Member States and of the United States:

Where such acts are established, the account is closed and, to the extent legally required, requests from judicial authorities are answered.

19.4. Do not write your special category data. Profile text, messages, road reports and chat rooms are free-text fields. Do not write your health status, your religious or philosophical beliefs, your political opinions, your sex life or other special category personal data into those fields. We do not aim to process such data and we cannot screen free-text fields for it.

ARTICLE 20 — Your content and the licence you grant

20.1. The content is yours. The rights in the messages, photographs, road reports and profile text you share remain with you; this contract does not transfer your authorship or your economic rights to us.

20.2. Scope of the licence granted. So that we can display your content in the app, store it and process it technically, you grant a non-exclusive and royalty-free licence to use it within the meaning of Turkish Law No. 5846 on Intellectual and Artistic Works ("FSEK"). The licence covers the following economic rights solely for the purpose of supplying the service and only to the extent that purpose requires:

20.3. What the licence does not cover. The licence does not cover use of your content in advertising, promotion or marketing, or anywhere outside the supply of the service, its sale to third parties, or the right of distribution (Article 23 FSEK). Your moral rights (Articles 14 to 17 FSEK) are inalienable and have not been transferred by this contract. For users outside Türkiye, the same limits apply to the equivalent rights under the copyright law applicable to them.

20.4. Sub-licensing. The licence includes the power to grant sub-licences to the hosting and infrastructure providers we use in order to supply the service technically, limited to the same purpose and the same scope. No sub-licence is granted for any other purpose.

20.5. Territory and duration. The licence is worldwide. Its duration is the period for which the content is present in the app. The licence ends when you delete the content or close your account; removal from technical backups may take a reasonable time.

20.6. Exceptions to the licence ending. In the following cases a copy of the content continues to exist in the system, and to that extent the licence continues, limited to the purpose of retention:

20.7. What becomes of the licence on a transfer. If the business passes to a third party by way of a merger, transfer or restructuring, this licence passes to the successor with the same scope and the same limits. Without this exception the transfer provision in Article 31.1 would be inoperable; it is therefore stated expressly.

20.8. Your representation. You represent that you hold the necessary rights in the content you share and that the content does not infringe the rights of third parties.

20.9. We reserve the right to remove content that breaches the rules and to suspend an account. The removal procedure is set out in Articles 22 and 23.

ARTICLE 21 — Traknock's intellectual property rights

21.1. The source code of the app is protected as a work of science and literature under Article 2/1 FSEK. Protection arises automatically upon creation of the work, without any need for registration. The interface design, the visual material, the texts and the logo are covered by the same Law to the extent that they qualify as works. In the European Union computer programs enjoy equivalent protection under Directive 2009/24/EC, and in the United States under Title 17 of the United States Code.

21.2. Trade mark. The service provider's rights in the name and logo "Traknock" arising from use are reserved. As at today's date that name is not a registered trade mark; trade mark registration proceedings will be commenced. Nothing in this text asserts that the mark is registered.

21.3. The right granted to you. You are granted a non-exclusive, non-transferable licence to use the app, which may not be sub-licensed and which lasts for the term of this contract, to use it for the purpose for which it is supplied. The licence covers use of the app's own functions; a driver or a fleet operator using the app in the course of their own commercial activity falls within it and is not prohibited. What the licence does not cover is commercialising the app itself: you may not copy, sell, rent, publicly lend the app, produce derivative works from it, or offer it to anyone else as a service. Using the app to send advertising, promotion or bulk messages to third parties is separately prohibited under Article 19.1.

21.4. Reverse engineering. Converting the app into source code, decompiling it or modifying it is prohibited as a rule. That prohibition does not displace the mandatory exceptions for computer programs in Article 38 FSEK: the right of a person who has lawfully acquired the program to make a back-up copy, and acts carried out within the limits the law permits in order to achieve interoperability, are reserved. For users in the European Union the same result follows from Articles 5(2) and 6 of Directive 2009/24/EC, and Article 8 of that Directive renders contractual provisions contrary to those exceptions null and void. We accept that we cannot remove by contract a power the law expressly confers.

21.5. Notice of copyright infringement. If you believe that content in the app or on the site infringes your rights, you may notify us at info@traknock.com. The procedure and the time limit are explained in Articles 23.5 and 23.6.

ARTICLE 22 — Automated content moderation, sanctions and appeal

22.1. Scope of moderation. One-to-one messages, street and general chat messages and road reports are scanned, the moment they are written, by a system that operates without human involvement. Content found to breach the rules is deleted or masked and the corresponding notification is suppressed. Photographs are not part of that text scan; they pass through a separate check on the device before being sent.

22.2. Thresholds for automatic closure of an account. On repeated breaches the account is closed automatically. The thresholds differ deliberately:

Type of breachAutomatic closure threshold
Sexual content3 breaches
Profanity8 breaches

22.3. The original text of blocked content is retained as a breach record, up to a limited length (the first 500 characters). Those records are accessible only server-side; they are closed to other users.

22.4. Proportionality of sanctions. A sanction is applied in proportion to the gravity of the breach: removal or masking of the content, temporary restriction of a feature, temporary suspension of the account, permanent closure of the account.

22.4/a. Notification of the reason. The reason for an automatic closure is written to the account record on the server; a notification is sent at the moment of closure, and a screen inside the app shows the reason and the date of the decision (added on 20 September 2026). You can also always obtain the reason by writing to the address in Article 22.5; your request is answered within thirty days at the latest. For users in the European Union, that screen also satisfies the statement of reasons required by Article 17 of Regulation (EU) 2022/2065 (the Digital Services Act).

22.5. Human review and your right to object. Where an account has been closed automatically you have the right to obtain re-assessment of the decision by a human being, to express your point of view and to contest the decision. Those rights are expressly provided for in Article 22(3) GDPR. Your right under Article 11/1(g) KVKK to object to an adverse outcome arising from analysis carried out exclusively by automated systems is reserved, and in addition we undertake, voluntarily, to provide human review.

Applications: privacy@traknock.com. Requests are concluded within 30 days at the latest; that period is consistent with the maximum period in Article 13/2 KVKK and with Article 12(3) GDPR.

22.6. Automated filtering is open to error. Content that does not breach the rules may be blocked and content that does may be missed; there is no undertaking that content moderation will operate flawlessly.

ARTICLE 23 — Our status as an intermediary and how content is reported and removed

23.1. Our capacities in Türkiye. For the purposes of Turkish Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed by Means of Such Publications, we hold three capacities at once:

23.1/a. Our status in the European Union and in the United States. Where the service is offered in the European Union we are a provider of hosting services within the meaning of Regulation (EU) 2022/2065 (the Digital Services Act), and Article 16 (notice and action mechanisms) and Article 17 (statement of reasons) of that Regulation apply to us. Under Article 19 of that Regulation, providers that qualify as micro or small enterprises are exempt from the additional obligations for online platforms in Section 3; we nonetheless operate, voluntarily, the internal complaint route described in Article 22.5. In the United States we are a provider of an interactive computer service within the meaning of 47 U.S.C. § 230, and the user who creates an item of content is the information content provider of that content.

23.2. The right of third parties to apply. A person who does not use the app — for example, someone whose photograph, number plate or name has been shared without their consent — may also request that the content be removed. They do not need to open an account in order to do so.

23.3. What an application must contain:

23.4. Channel and time limit. Applications are made to info@traknock.com. The applicable time limits are set in two tiers in Article 13 of the Community Rules and are binding for the purposes of this contract as well: where the breach is apparent at first sight the content is removed from publication without delay and in any event within 24 hours; where an assessment is required the application is concluded within 7 days at the latest and the outcome is notified to the applicant. Should the two documents conflict, the shorter period, being the one in the applicant's favour, applies.

23.4/a. Notices of copyright infringement from the United States. Notices under 17 U.S.C. § 512(c) may be sent to info@traknock.com. A notice should contain the elements listed in § 512(c)(3): identification of the copyrighted work, identification of the material claimed to be infringing, the complainant's contact details, a statement of good faith belief, a statement that the information is accurate, a statement made under penalty of perjury that the complainant is authorised to act, and a signature. A designated agent has not yet been registered with the United States Copyright Office; that registration will be completed before the app is published in the United States. Until then, the safe harbour under § 512 is not relied on, and notices are processed on the same terms as any other removal request.

23.5. Routes of recourse. If your request is not met, we inform you of the routes open to you:

23.6. Where content constituting a criminal offence is identified, a report is made to the relevant authorities and lawful requests of the competent authorities are answered.

ARTICLE 24 — Protection of personal data

24.1. The purposes and legal bases on which your personal data are processed, the recipients to whom they are transferred, the periods for which they are retained and your rights under Article 11 KVKK and Chapter III GDPR are explained in detail in the Privacy Policy.

24.2. We also state here that the data are held in data centres inside the European Union and that this accordingly constitutes a transfer abroad within the meaning of Article 9 KVKK. The legal basis of the transfer is set out in the Privacy Policy.

24.3. Acceptance of this contract does not amount to explicit consent to the processing of personal data. Separate, withdrawable consent is obtained for processing that requires consent; the privacy notice and the explicit-consent text are separate documents.

24.3/a. Users in the United States. If you are a resident of California, the California Consumer Privacy Act as amended by the California Privacy Rights Act gives you rights to know, to delete, to correct, to opt out of the sale or sharing of personal information for cross-context behavioural advertising and not to be discriminated against for exercising those rights; residents of other states have comparable rights under their own state privacy legislation. Requests may be sent to privacy@traknock.com. How advertising identifiers are used is explained in the Privacy Policy.

ARTICLE 25 — Continuity of the service

25.1. We aim to supply the service without interruption but do not guarantee it. Temporary interruptions may occur through maintenance, updates, infrastructure faults and similar causes.

25.2. We reserve the right to change, add or remove features. If we withdraw a paid feature or narrow it substantially, we inform the affected users in advance and apply the procedure in Article 26.

25.3. If the service is discontinued entirely, users are informed at least 30 days in advance, and the treatment of unused paid entitlements is announced in the same notice.

ARTICLE 26 — Changes to these terms and how they take effect

26.1. Under Article 24 TBK a clause giving us the power to amend the contract unilaterally to your detriment is deemed not written. We therefore divide the amendment procedure in two.

26.2. Non-material changes. Corrections of wording, explanatory additions and changes that do not affect your rights and obligations take effect upon publication on this page; the version date at the top of the page changes.

26.3. Material changes. Changes to charging, to sanctions, to the user content licence, to the limits of liability and to dispute resolution are material. The procedure for those is:

26.4. Continuing to use the app is not by itself acceptance of a material change. The clause to the contrary in the earlier version has been removed because it carried a risk of being an unfair term.

26.5. Mandatory updates arising from changes in legislation take effect on the date the law prescribes, independently of this Article.

ARTICLE 27 — Suspension, termination and the consequences of ending

27.1. Your right to terminate. You may delete your account at any moment, without giving a reason (see Account and Data Deletion). You do not have to apply to us in order to terminate.

27.2. Our right to terminate and to suspend. If you act in breach of these terms we may suspend or close your account, in proportion to the gravity of the breach. The reason for a closure decision is notified, and the route of appeal in Article 22.5 is open.

27.3. In cases of urgency, in order to prevent the continuation of an unlawful situation, an account may be suspended immediately with notification given afterwards.

27.4. Consequences of ending. When the contract ends, your right to use the app ends. Article 18 applies to tokens and subscriptions, Articles 20.5 and 20.6 to user content and the Privacy Policy to personal data.

27.5. Provisions which by their nature must remain in force after the contract ends (intellectual property, liability, dispute resolution and jurisdiction) continue to have effect after termination.

ARTICLE 28 — Liability

28.1. The relationship between users. Traknock is not a party to loss arising from the communications users establish with one another, from meetings, or from help given or received. Exercising reasonable care in your interactions with other users is your responsibility.

28.2. User content. The user who creates content is responsible for its accuracy, its lawfulness and its not infringing the rights of third parties. The consequences of our capacity as a hosting provider are explained in Article 23.

28.3. Road reports and the map. No undertaking is given as to the accuracy, currency or completeness of road reports, map data or location information.

28.4. How the service is supplied. The app is supplied "as is"; no undertaking is given that the service will be uninterrupted, error-free or fit for a particular purpose.

28.5. The limits of the exclusion clause — this Article is not absolute. The limitations above do not apply in the following cases:

No provision of this text may be interpreted so as to exclude or limit the liabilities listed above. The words in the earlier version — "Traknock cannot be held liable for any accident, violation or damage occurring while the app is used" — have been removed because they were absolute and would for that reason have been treated as invalid.

ARTICLE 29 — Force majeure

In the event of natural disaster, war, epidemic, cyber attack, infrastructure and internet outages, decisions of public authorities and comparable events beyond the parties' control, no liability arises for delay or failure to perform caused by that situation. If a situation of force majeure lasts longer than 30 days, either party may terminate the contract.

ARTICLE 30 — Notices and service

30.1. Notices to you are delivered as in-app announcements; changes to these terms are additionally published on this page.

30.2. For notices to us the address info@traknock.com is valid. For applications concerning personal data, privacy@traknock.com is used.

30.3. The routes of application listed in the Turkish Communiqué on the Procedures and Principles of Application to the Data Controller (written application, registered electronic mail, secure electronic signature, mobile signature) are reserved. The postal address required for a written application will be published in this text once the identity details are complete. Until that date we also treat applications made by email as duly made, and answer them.

ARTICLE 31 — Assignment, severability, waiver and language

31.1. Assignment. The service provider may assign the rights and obligations arising from this contract to a third party in the event of a merger, transfer or restructuring; users are informed in advance. Assignment of the user content licence is subject to Article 20.7. You may not assign your rights under this contract to a third party.

31.2. Severability. A provision being held invalid, deemed not written or unenforceable does not affect the validity of the other provisions; the valid provision closest to the parties' purpose applies in place of the invalid one.

31.3. Waiver. A failure to exercise a right, or a delay in exercising it, does not mean that the right has been waived.

31.4. Language. This contract exists in Turkish and English versions. In the event of a conflict the Turkish version prevails. This does not deprive a consumer of the protection of a provision of the mandatory law of their own country requiring the contract to be supplied in a particular language. This English version carries additional provisions specific to users in the European Union and the United States; those additional sub-articles are lettered (for example 23.1/a), so that the sub-articles common to both versions bear the same number and may be cross-referenced directly. Those additional provisions do not displace the provisions of the Turkish version; for users in those territories they are added to them.

ARTICLE 32 — Governing law, dispute resolution and jurisdiction

32.1. This contract is governed by the law of the Republic of Türkiye.

32.2. Users who are consumers in Türkiye. If you are a consumer within the meaning of Law No. 6502, then according to the monetary value of the dispute:

Value of the dispute (2026)Competent body
Below TRY 186,000 Provincial or District Consumer Arbitration Committees
TRY 186,000 and above Consumer Courts

That monetary threshold applies from 1 January 2026 and is updated by the Turkish Ministry of Trade at the start of each calendar year at the revaluation rate; the threshold in force at the time of the application is the one that applies.

32.3. Venue. An application is made to the arbitration committee or the court of the consumer's place of residence or of the place where the consumer transaction was carried out. That choice belongs to the consumer; this text contains no jurisdiction clause excluding the court of the consumer's place of residence.

32.4. Users who are not consumers. Under Article 17 of the Code of Civil Procedure No. 6100, a jurisdiction agreement may be concluded only between merchants or public legal persons. Accordingly: in disputes with users holding the capacity of merchant or public legal person, the courts and enforcement offices of Istanbul have jurisdiction; for users not holding those capacities the general jurisdiction rules of the law apply.

32.5. Users outside Türkiye. For consumers using the app from outside Türkiye, the mandatory consumer-protection provisions of the country of habitual residence and the right to bring proceedings in that country are reserved. For consumers in the European Union this follows from Article 6(2) of Regulation (EC) No 593/2008 ("Rome I") and Article 18(1) of Regulation (EU) No 1215/2012 ("Brussels I bis"). You may also bring your complaint before a certified alternative dispute resolution entity in your own Member State under Directive 2013/11/EU. Consumers in the United States may bring a claim in the small claims court of their place of residence; nothing in this contract requires arbitration or waives the right to a jury.

32.6. In disputes concerning personal data, your right to complain to the Turkish Personal Data Protection Board and, for users established in the European Union, to the competent supervisory authority under Article 77 GDPR is reserved.

ARTICLE 33 — Entry into force and updates

33.1. This version was published on 18 September 2026 and enters into force on the date of its publication.

33.2. Version history:

VersionDateScope
1 7 September 2026 First publication
2 18 September 2026 Alignment with the review of standard terms and of unfair terms; removal of the absolute exclusion of liability; amendment of the unilateral change procedure; minimum age raised to 15; the token economy, the message fee, the driving lock and the subscription provisions set out in line with how the app actually works; the user content licence redefined by reference to FSEK; addition of our status under Law No. 5651 and of the content removal procedure; the European Union and United States layer (Digital Services Act, Directive 2009/24/EC, Directive (EU) 2019/770, Rome I, COPPA, DMCA, CCPA) written into the English version. In an adversarial review the same day: the fact that posting in the room chats requires a Prime subscription was written into Article 13 and into the list of surprising provisions; the tier frame was corrected to appear in the nearby drivers list rather than on the map, and separated from the Boost ring on the map (Article 16.4); the list of provisions not yet in force was narrowed so as to state that Articles 12 and 15 are in force today; the divergence between the server (UTC+3) and the app display (device time) for daily entitlements was disclosed (Article 15.4); the removal of a report that receives four "incorrect" votes was added (Article 9.3); the word "unilaterally" was removed from the rewarded advertising ceiling because of Article 24 TBK; the "non-commercial" restriction in the user licence was corrected because it conflicted with Article 32.4, which contemplates merchant and fleet users; the divergence in article numbering between the Turkish and English versions was disclosed in Article 31.4. A consistency check across the whole set the same evening added or corrected three provisions: the fact that tokens spent on a message masked in moderation are not refunded automatically was written into Article 12.6, in the same form as Article 11.7 of the Community Rules; the sentence stating that "the reason is notified to the user" was removed, because no such screen exists in the app, and replaced by a statement of the position today together with an undertaking to be performed before publication (Article 22.4/a); and a warning showing which articles carry offset sub-article numbers between the two language versions was added to the annex

33.3. The amendment procedure is set out in Article 26. The entry-into-force date of each version is preserved in this section; if you need the text of an earlier version you may request it at info@traknock.com.
